Our attorneys develop, in consultation with our client, an overall defense strategy based on the facts and circumstances of each case. In doing so, we consider both presenting a defense case and emphasizing the prosecution’s constitutional burden of proving each element beyond a reasonable doubt.
Confronting the Prosecution’s Case
We are skilled and experienced at cross-examining and impeaching the prosecution’s witnesses. Cross examination includes:
(1) being alert to inconsistencies in witnesses’ testimony;
(2) being aware of all prior statements of the witnesses;
(3) being prepared with evidence that can be used to impeach the witnesses’ credibility (e.g., certain criminal convictions); and
(4) confronting witnesses with evidence that contradicts their testimony and calls into question their truthfulness.
Motion for Judgment of Acquittal
Our attorneys will take note of weaknesses in the prosecution’s proof and, when appropriate, will move for “judgment of acquittal,” which means asking the judge to immediately acquit the defendant (i.e., before the jury deliberates).
