Sentencing

In cases that reach sentencing, we strive to achieve a fair and appropriate sentence for our clients. Our attorneys are well-versed in the applicable law and various sentencing options and will develop a sentencing recommendation tailored to our clients’ interests and the circumstances of each case. We take the steps necessary to effectively advocate for the right sentence. We prepare for sentencing by:

(1)   ensuring that our client is not harmed by inaccurate information or information that is not properly before the court;

(2)   ensuring that all available mitigating and favorable information, which is likely to benefit our client, is presented to the court;

(3)   preparing evidence and securing witnesses in support of our sentencing recommendation; and

(4)   in certain cases, preparing a written sentencing memorandum in support of our recommendation.

 

 

We understand the sentencing procedures applicable to any given case, including:

(1) the effect that plea negotiations may have upon the sentencing discretion of the court;

(2) the operation of any sentencing guideline system;

(3) the preparation of a presentence report;

(4) the use of a sentencing memoranda;

(5) the opportunity to challenge information presented to the court for sentencing purposes; and

(6) the participation of witnesses in the sentencing proceedings.
