Case Review and Preparation
Our case review and preparation begins with gathering evidence and information, which can come from several sources:
Charging Documents – We obtain and examine copies of all charging documents to determine the specific charges that have been brought. We review the applicable law to identify:
(1) the elements of the offense(s) with which the accused is charged;
(2) the defenses, ordinary and affirmative, that may be available;
(3) any defects in the charging documents, constitutional or otherwise, such as statute of limitations, double jeopardy, or irregularities in the Grand Jury proceedings.
Client – We interview our clients to get their side of the story, including:
(1) seeking information about the incident or events giving rise to the charge(s) or improper police investigative practices or prosecutorial misconduct;
(2) exploring the existence of other potential sources of information relating to the offense; and
(3) collecting information relevant to sentencing.
Potential Witnesses – We interview potential witnesses, including any complaining witnesses. We work with several experienced private investigators, whom we often assign to interview potential witnesses and to serve them with subpoenas, if necessary.
Police and Prosecution – We obtain and carefully review “discovery,” which consists of evidence in the possession of the prosecution and law enforcement (e.g., police reports, photos, videos). We take the necessary steps to ensure that the police preserve all of the evidence and that the prosecution provides it to us.
Courts – We obtain docket records and court documents necessary to understand the procedural position of your case. When necessary, we also obtain and review tapes and transcripts of prior judicial proceedings.
Physical Evidence and Crime Scene – When appropriate, we make arrangements to view the physical evidence at issue as well as the crime scene itself.
Expert Assistance – In certain cases, we employ experts in order to:
(1) prepare the defense;
(2) understand the prosecution’s case;
(3) rebut the prosecution’s case;
(4) investigate the client’s competence to proceed, mental state at the time of the offense, and/or capacity to make a knowing and intelligent waiver of constitutional rights.
Identifying Legal Issues and Defenses
Our attorneys are skilled at identifying available defenses, legal issues, and the appropriate objections. Furthermore, we have the experience and understanding necessary to develop the best legal strategy for your case.
Defense Theory and Strategy
During investigation and trial preparation, our attorneys develop and continually reassess our theory of defense, which is based on the best interest of our clients as well as the realities of their legal situation.
We consult with our clients to ensure that they are fully informed before making important decisions about their cases, including:
(1) what pleas to enter;
(2) whether to accept a plea agreement;
(3) whether to waive jury trial;
(4) whether to testify in his or her own behalf; and
(5) whether to appeal.
