Pretrial Motions

In appropriate cases, our attorneys file pretrial motions with the court in order to protect our clients’ interests and constitutional rights. Pretrial motions include:

(1) motion to amend bail or petition for de novo review of bail;

(2) motion to dismiss based on the constitutionality of the criminal statute or defects in the charging process or document;

(3) motion for relief from prejudicial joinder of charges or co-defendants in the charging document;

(4) motion for additional discovery;

(5) motion for sanctions for noncompliance with discovery rules;

(6) motion to suppress evidence gathered in violation of the Fourth, Fifth, or Sixth Amendments to the United States Constitution, or corresponding or additional State of Maine constitutional provisions, including:

(a) the fruits of illegal searches or seizures;

(b) involuntary statements or confessions;

(c) statements or confessions obtained in violation of the client’s right to counsel or privilege against self-incrimination;

(d) unreliable identification evidence which would give rise to a substantial likelihood of irreparable misidentification;

(7) motion for state funding for the assistance of a private investigator or expert witness for the defense;

(8) motion a speedy trial;

(9) motion to continue court dates or extend court deadlines;

(10) motion in limine, dealing with the admissibility of evidence at trial based on the Rules of Evidence; and

(11) matters of trial or courtroom procedure.

 

 

 

When the court holds a hearing on a motion, our attorneys diligently prepare by carefully reviewing the evidence, thoroughly researching the law, and subpoenaing and preparing helpful witnesses.
